1. Website Owner and Scope of Application

Culturae Heritage Services srls (hereinafter, the "Company," the "Holder," or "We"), with its registered office at Via dei Banchi 6, 50123 Florence, Italy, VAT/Tax ID IT07519170489, Fiscal Code 07519170489, REA FI-709102, with a share capital of €4,000 fully subscribed, ATECO code 581900 (Other publishing activities, excluding software publishing), is the owner and operator of the website gaudi.museum (hereinafter, the "Website") and other websites with similar publishing purposes.

These Terms and Conditions of Use (hereinafter, the "Terms") govern access to the Website and its use by any individual or legal entity (hereinafter, the "User").

Accessing and using this website implies your full acceptance of these Terms and Conditions. If you do not wish to accept these terms, you are invited not to use the website.

2. Website Nature — Editorial Notice

This Website is not the official website of any museum, monument, cultural institution, public body, or any other third party. It does not speak on behalf of the entities that own the cultural, tourist, or museum sites described in its content, nor does it represent their intentions, desires, or official positions.

The website has an exclusively editorial and informational nature. The company operates as a digital publisher with the ATECO code 581900 and is not:

  • a tour operator as defined by Italian Legislative Decree 79/2011 (Tourism Code);
  • neither a travel agency nor a travel intermediary;
  • a travel package organizer or seller;
  • a provider of tourism services, guided tours, or experiences;
  • Neither the official entity nor the owner of the domain name for any of the cultural sites described.

The website publishes original editorial content (articles, guides, practical information) about cultural, tourist, and museum locations, and it suggests tours, guided visits, and experiences offered by independent partners, earning a commission when a user is directed to them.

The website does not constitute a journalistic publication, as it is not updated on a regular basis. Therefore, it cannot be considered an editorial product in the sense of Italian Law No. 62, of March 7, 2001.

3. Editorial Content

All content on the website (texts, articles, guides, practical information) is created by the website's editorial team, unless otherwise stated. It is freely inspired by the cultural sites described and is published in exercise of the right to freedom of expression and information enshrined in Article 21 of the Italian Constitution and in Article 10 of the European Convention on Human Rights.

The content provided is for informational purposes only and does not constitute an offer to the public, professional advice, a contractual commitment, or an invitation to invest.

Some of the editorial content is produced with the support of machine translation tools and generative artificial intelligence, under human editorial supervision.

4. Tours and Experiences — Affiliate Program

The website does not sell tours or experiences, and it does not handle bookings or payments.

When the website presents a tour or experience, it links to the website of an independent business partner. Depending on the content published, these partners may be: GetYourGuide, Viator (Tripadvisor group), Tiqets, Civitatis, Headout.

In all of those cases:

  • The purchase agreement is concluded exclusively between the User and the third-party partner.
  • The company is not a party to that contract and assumes no responsibility whatsoever for bookings, payments, service provision, cancellations, refunds, or claims.
  • The Company does not collect, process, or store in any way the User's payment data (card numbers, bank details, security codes);
  • The invoice and the voucher for the tour purchased are issued directly by the partner company.
  • For any claims, refund requests, or cancellations related to a tour that has been purchased, the user must contact the partner company directly.
  • The processing of personal data of the User on the partner's website is governed by the privacy policy of that partner.
  • The company charges a commission from the member for referrals.

The prices, availability, schedules, and conditions displayed on the website are sourced from our partners' systems and may not be updated in real-time. The definitive information is that which is displayed on the partner's website at the time of booking.

5. Classification of results and offers

When the website displays search results, rankings, or lists of tours and experiences from multiple partners, the primary factors that determine the order in which they are presented may include:

  • the relevance of the content on the page being viewed;
  • the availability of the experience on the requested dates;
  • the ratings and the number of reviews provided by the partner;
  • The commercial relevance, understood as the affiliate commission that corresponds to the Company.

Commercial relevance is one of the criteria used for ranking: a higher ranking may correspond to a larger commission for the company. No partner pays for a specific placement outside of this criterion.

This information is provided in accordance with Article 22, paragraph 4-bis, of the Italian Consumer Code (Legislative Decree 206/2005).

6. Newsletter

The user can subscribe to the website's newsletter to receive updates, editorial content, and information about tours and experiences.

The subscription is voluntary and occurs only with prior and explicit consent. The user can withdraw their consent and unsubscribe at any time by clicking the unsubscribe link included in each message, or by writing to the address indicated in section 1. Messages are sent via Amazon SES (eu-west-1 region, Ireland).

7. Ratings and Reviews

When the website displays ratings or reviews of tours and experiences, these come from the platforms of our partners (GetYourGuide, Viator, Tiqets, Civitatis, Headout), which collect them from users who have booked through their systems. These reviews are reproduced exactly as provided by the source platform, with clear indication of their origin. The company does not alter the content or ratings of third-party reviews.

The website does not collect reviews directly from its own users.

8. Intellectual property and copyright

8.1 Original Content

All original content on the website (text, articles, guides, layout, graphics, source code) is owned by Culturae Heritage Services srls and is protected by Italian and European copyright laws (Law 633/1941 and its amendments, Directive 2001/29/EC).

Reproduction, distribution, public communication, or any other use, even partial, of the original content of the website is prohibited without the prior written consent of the copyright holder, except in cases permitted by law (e.g., the right to quotation and educational use).

8.2 Third-Party Content

The website also uses content owned by third parties, including:

  • Images licensed from stock photography agencies;
  • Images and content provided by our business partners;
  • images that are in the public domain or that are freely available for use for other reasons;

All content belonging to third parties remains the property of its respective owners and is used in accordance with applicable licenses. Whenever possible, each piece of copyrighted content is accompanied by an indication of its source.

8.3 Trademarks and brand names

The names of museums, monuments, institutions, tour operators, and any other trademarks mentioned on the website belong to their respective owners. Their use on the website is purely descriptive and informational and does not imply any affiliation, endorsement, or commercial relationship with the trademark owners, unless expressly stated otherwise.

9. Limitation of Liability

The company strives to publish accurate and up-to-date information. However:

  • The information on this website is provided for informational purposes only and does not constitute an offer to the public, professional advice, or a contractual commitment.
  • The company does not guarantee the accuracy, completeness, timeliness, or suitability of the content published, particularly with regard to opening hours, ticket prices, availability, and conditions of tours and experiences, which are subject to change by third parties.
  • The company is not liable for any direct or indirect damages, whether financial or non-financial, arising from the use of the information on the website, from reliance on that information, or from the inability to access the website.
  • The company is not responsible for the content, policies, practices, or services of third-party websites that are accessible through links on the Website.
  • The company is not responsible for anything related to reservations, payments, service provision, cancellations, or refunds, as these are handled entirely by third-party partners.
  • Any inaccuracy, lack of sources, error, or omission in the content should be considered a good-faith mistake.

Nothing in this section limits the liability that cannot be excluded under mandatory regulations, including liability for fraud or gross negligence, and the rights that mandatory provisions grant to consumers.

10. Reporting of errors and violations of rights

If the User detects inaccuracies, errors, inappropriate content, or content that violates their rights—including copyright on an image or text—they are invited to report it without delay to [email protected], indicating the affected page and the reasons for the communication.

The images published on the website have been obtained after verifying that they are properly licensed, are in the public domain, or are freely available for use for another reason. When a complaint is deemed valid, the company undertakes to verify it and to promptly remove or correct the content in question.

11. Links to third-party websites

The website contains links to third-party websites (business partners, social media platforms, service providers). These links are provided for informational purposes and user convenience. The company does not control the content, privacy policies, or practices of these websites and disclaims all responsibility in relation to them.

12. Service Availability

The Company reserves the right to modify, suspend, or terminate the Website or any part of its services at any time, without prior notice and without any obligation to provide compensation.

13. Modifications to the Terms

The Company reserves the right to modify these Terms at any time. Each version will be identified by a version number and an effective date, indicated at the top of this page. Any changes will take effect from the date they are published on the Website. Continued use of the Website after the publication of any changes constitutes acceptance of the new Terms.

14. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Italian law.

For any dispute relating to the interpretation or enforcement of these Terms, the court of Florence shall have exclusive jurisdiction, unless mandatory consumer protection regulations provide otherwise. In the latter case, the competent court shall be that of the consumer's place of residence or domicile if located in Italy, or the one determined by Regulation (EU) No. 1215/2012 for consumers residing in other EU Member States.
